SC refers curative petition on 377 to constitution bench

The Supreme Court has referred the Section 377 curative petition to a five judge Constitution Bench for further examination. The petition is challenging the Court’s ruling in 2013 which upheld the Section 377.

All India Churches Association and Muslim Personal Law Board made brief submissions arguing against reconsideration of the Kaushal judgment.

The referral is indicative of the fact that the judges are considering the rights of sexual minorities with gravitas.
